1. Acceptance of Terms
By downloading, installing, accessing, or using Swipe ("the app," "the service," or "we/us/our"), you ("the user" or "you") agree to be bound by these Terms of Service, our Privacy Policy, and our Health Disclaimer, all of which are incorporated herein by reference. If you do not agree to all of these terms, you must not use the app.
These terms constitute a legally binding agreement between you and Swipe Dining LLC ("the company"). Your continued use of the app after any modifications to these terms constitutes your acceptance of the modified terms.
2. Eligibility & Age Requirements
Swipe is designed primarily for college-age users and members of the UConn community. You must be at least 13 years of age to use Swipe. If you are between 13 and 17 years of age (or under the age of majority in your jurisdiction), you may only use the app with the verifiable consent and supervision of a parent or legal guardian who agrees to be bound by these terms.
If you are under 13, you may not use the app. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected information from a child under 13, we will delete it promptly.
By using the app, you represent and warrant that you meet the eligibility requirements stated in this section. If you are a parent or guardian who has consented to a minor's use of the app, you agree to be fully responsible for the minor's use and to be bound by these terms.
3. Service Description
Swipe is a free mobile application that provides:
- Dining hall menu information for the University of Connecticut, sourced from publicly available records
- Nutrition data aggregated from university dining records, restaurant-published information, and third-party databases including Open Food Facts and USDA FoodData Central
- Health scores (0–99) generated by a proprietary algorithm based on nutritional content
- Allergen and dietary restriction filtering based on available data
- A personal food journal for tracking daily meals and nutrition intake
- Off-campus restaurant listings with menu and nutrition information
- Barcode scanning for packaged food product lookup
- Personalized score adjustments based on user-provided health conditions
- Crowdsourced reports including missing menu items and dining hall busy levels
Affiliation Disclaimer: Swipe is an independent application. It is not affiliated with, endorsed by, sponsored by, or officially connected to the University of Connecticut, UConn Dining Services, Chartwells, or any restaurant, food manufacturer, or dining establishment whose information appears in the app.
4. Not a Medical Device or Health Service
Swipe is not a medical device, health service, or clinical tool. It has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA), any state health department, or any other regulatory body. It is not intended to diagnose, treat, cure, mitigate, or prevent any disease or health condition.
Despite the use of terms like "health score," "healthy," "good for," or similar language within the app, Swipe does not provide:
- Medical advice, diagnosis, or treatment recommendations
- Clinical nutrition therapy or medical nutrition therapy
- Dietitian-level or physician-level dietary guidance
- Diagnosis or screening for any health condition, disease, or disorder
- Monitoring of any medical condition or vital health parameter
The health scores and dietary information in Swipe are generated by an algorithm created by the app's developers. They have not been reviewed, validated, or endorsed by any registered dietitian, nutritionist, physician, or healthcare professional.
5. Health & Nutrition Disclaimer
The health scores, nutrition data, calorie calculations, macro/micronutrient targets, and all dietary information provided by Swipe are:
- For general informational purposes only, they do not constitute medical, nutritional, or dietary advice of any kind
- Algorithmically generated estimates, health scores are computed from publicly available nutrition data using a simplified formula and may not reflect your individual health needs, metabolism, body composition, or medical requirements
- Not guaranteed to be accurate, complete, or current, nutrition information is sourced from university dining records, restaurant-published data, and third-party databases, all of which may contain errors, omissions, or outdated information
- Not personalized medical guidance, even when scores are adjusted for user-reported health conditions (e.g., diabetes risk, high blood pressure, cholesterol), these adjustments are simplified heuristics that do not account for your complete medical history, medications, or individual physiology
- Not a substitute for professional consultation, always consult a qualified healthcare provider, registered dietitian, or licensed nutritionist before making dietary decisions, especially if you have any medical condition
Daily Nutrition Targets
The app calculates suggested daily calorie, macronutrient, and micronutrient targets based on self-reported age, gender, height, weight, activity level, and fitness goals. These calculations use general formulas and are not individualized medical recommendations. They do not account for pregnancy, breastfeeding, medical conditions, medications, metabolic disorders, or other factors that affect nutritional requirements. You should not use these targets as a substitute for guidance from a qualified healthcare or nutrition professional.
Specific Medical Conditions
You should not rely solely on Swipe for dietary decisions if you have any medical condition including but not limited to: diabetes (Type 1 or Type 2), heart disease, hypertension, kidney disease or renal conditions, celiac disease, food allergies, eating disorders (current or in recovery), polycystic ovary syndrome (PCOS), thyroid conditions, irritable bowel syndrome (IBS), iron deficiency or anemia, osteoporosis or bone density concerns, migraines, mental health conditions that affect appetite or diet, or any other condition that requires medically supervised nutrition.

6. Allergen Warning
CRITICAL SAFETY WARNING: If you have food allergies or sensitivities of any kind, you must always verify allergen information directly with dining staff, restaurant employees, or the food manufacturer before consuming any food item. Do not rely on Swipe as your sole source of allergen information.
While Swipe provides allergen filtering and warnings based on available data, you must understand the following limitations:
- Incomplete data: Allergen information is sourced from university dining records and restaurant-published data, which may not list all allergens present in a food item
- Cross-contamination: Cross-contamination risks in shared kitchen environments, shared cooking equipment, and shared serving areas are not tracked, predicted, or displayed by the app
- Recipe changes: Menu items, recipes, ingredients, and preparation methods may change at any time without notice to us
- Parsing limitations: Allergen data is extracted from external sources using automated methods that may misidentify, omit, or incorrectly categorize allergens
- "Safe" does not mean allergen-free: When Swipe labels a food as "safe" for your allergens, or filters items using "Safe For Me," this means only that the allergen was not listed in the data available to us, it does not guarantee the food is free of that allergen
- Hidden allergens: Some allergens may be present in ingredients, derivatives, or processing aids that are not disclosed in the source data
Users with anaphylaxis, severe food allergies, or any life-threatening food sensitivities must independently verify all allergen and ingredient information with the food provider before consuming any food item. Swipe expressly disclaims all liability for allergic reactions, adverse health effects, or any harm resulting from reliance on the app's allergen data, filtering, or warnings.
7. Wellness Mode & Mental Health Features
Swipe includes a "Wellness Mode" designed for users who self-identify as being in eating disorder recovery or who prefer a less score-focused experience. When enabled, this mode modifies the display of health scores and removes certain judgmental language.
Wellness Mode is not a therapeutic tool. It is not a substitute for professional treatment for eating disorders or any mental health condition. It has not been designed, reviewed, or approved by any mental health professional, therapist, psychiatrist, or eating disorder specialist.
- Wellness Mode does not provide counseling, therapy, or clinical support of any kind
- It may not be appropriate for all users in eating disorder recovery, if you are in treatment, discuss with your treatment team whether using a nutrition-related app is appropriate for you
- The app may still display nutrition information, calorie counts, and food-related content that could be triggering for individuals with eating disorders
- If you are experiencing an eating disorder crisis, please contact the National Alliance for Eating Disorders helpline at 1-866-662-1235
8. Data Accuracy & Limitations
Swipe aggregates data from multiple external sources. We make reasonable efforts to provide accurate information, but we cannot and do not guarantee the accuracy, completeness, timeliness, or reliability of any data displayed in the app.
Nutrition Data
- Nutrition values (calories, macronutrients, micronutrients) are estimates based on publicly available data and may differ from actual values
- Serving sizes may not match actual portions served
- Recipes and ingredients change frequently; our data may not reflect the most current version
Menu Data
- Dining hall menus are scraped from public university sources and cached; the menu you see may not match what is currently being served
- Menu availability, hours, and locations may change without notice to us
- Special dietary options, seasonal items, and limited-time offerings may not be accurately reflected
Restaurant Data
- Off-campus restaurant information (menus, nutrition data, hours, locations, deals) is provided for convenience only and may be outdated or incorrect
- Restaurant data is sourced from restaurant-published information and third-party databases; we do not independently verify this data
Product Data
- Barcode scanning uses third-party databases (including Open Food Facts and USDA FoodData Central) that are community-maintained and may contain errors
- Product formulations, ingredients, and nutrition facts may change between manufacturing runs
Cached & Stale Data
- The app uses caching to improve performance; data you see may not be the most recent version available
- Locally stored data (favorites, journal entries, cached menus) may become outdated
9. User-Submitted Content
The app allows you to submit various types of content to our servers, including:
- Feedback and bug reports (you may optionally include contact information in feedback submissions, which will be associated with your submission)
- Missing menu item reports
- Dining hall busy level reports
- Food item requests
- Restaurant addition requests and edit suggestions
By submitting content through the app, you:
- Represent that the information you submit is truthful and accurate to the best of your knowledge
- Grant Swipe Dining LLC a non-exclusive, worldwide, royalty-free license to use, display, and incorporate your submissions to improve the service
- Acknowledge that your submissions may be visible to other users in aggregate form (e.g., busy level averages, missing item report counts)
- Agree not to submit content that is false, misleading, defamatory, harassing, obscene, or otherwise objectionable
- Understand that submissions are associated with an anonymous device identifier, not your personal identity
We reserve the right to remove, edit, or refuse to display any user-submitted content at our sole discretion.
10. Crowdsourced Data Disclaimer
Certain features in Swipe rely on data submitted by other users, including:
- Missing menu item reports: Reports that a food item was not available at a dining hall are submitted by users and are not independently verified by us or by university dining services
- Busy level reports: Dining hall occupancy levels are self-reported by users and represent individual perceptions, not actual measured occupancy
Crowdsourced data may be inaccurate, misleading, or submitted in bad faith. We do not verify, validate, or guarantee the accuracy of any crowdsourced information. You should not rely on crowdsourced data for time-sensitive or critical decisions.
11. Device Permissions
Swipe may request access to the following device features:
- Camera: Used for scanning barcodes on packaged food items and QR codes on UConn nutrition labels. Camera data is processed locally on your device and is not stored, transmitted, or recorded by us
- Location: Used to calculate and display distances to nearby off-campus restaurants. Location data is processed locally and is not stored on our servers. Location access is optional and the app functions without it
- Notifications: Used to send alerts about food availability at dining halls based on your subscriptions. See Section 12 for details
You may revoke any of these permissions at any time through your device's settings. Revoking permissions may limit certain app features but will not affect core functionality.
12. Push Notifications & Background Activity
If you enable push notifications, the app may:
- Send notifications about food availability based on your favorites and subscriptions
- Include food names, dining hall locations, meal times, and health scores in notification content
- Run background tasks periodically (approximately every 4 hours) to check for food availability updates, even when the app is not actively open
- Continue background activity after the app is closed or the device is restarted
Notification Privacy: Push notification content may be visible on your lock screen or notification center. If you have dietary preferences, health conditions, or allergen settings that you consider private, be aware that notification content could reveal information about your dietary habits to anyone who can see your device's notifications.
You can disable push notifications at any time through your device settings or within the app.
13. Acceptable Use
You agree to use Swipe only for its intended purpose as a dining information tool. You may not:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app or its health scoring algorithm
- Use the app to submit false, misleading, or fraudulent reports, feedback, or other content
- Attempt to access admin endpoints, backend systems, APIs, or databases without authorization
- Scrape, copy, republish, or redistribute the app's content, data, health scores, or nutrition information in bulk or for commercial purposes
- Use the app or its data to create a competing product or service
- Interfere with or disrupt the app's servers, networks, or infrastructure
- Impersonate another person or entity when using the app
- Use the app in any way that violates applicable local, state, federal, or international laws or regulations
- Use the app to provide medical, nutritional, or dietary advice to others, or represent the app's outputs as professional health guidance
14. Intellectual Property
The Swipe app, including its design, user interface, code, health scoring algorithm, branding, logo, and all original content, is the intellectual property of Swipe Dining LLC and is protected by applicable copyright, trademark, and other intellectual property laws.
Menu and nutrition data sourced from university dining services, USDA FoodData Central, Open Food Facts, and other public sources remains the property of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes, subject to these terms. This license does not grant you any rights to our intellectual property beyond what is necessary for personal use of the app.
15. Third-Party Services & Content
Swipe integrates with and relies upon the following third-party services, each governed by their own terms of service and privacy policies:
- PostHog: Anonymous usage analytics to help us understand feature usage and improve the app
- Sentry: Crash reporting and error monitoring for debugging purposes
- Supabase: Backend infrastructure for menu data storage and API services
- USDA FoodData Central: Nutritional data for barcode-scanned products
- Open Food Facts: Community-maintained product database for packaged food lookups
- Expo / React Native: App framework and notification delivery infrastructure
We are not responsible for the practices, availability, or content of any third-party service. Third-party services may collect data according to their own policies. We encourage you to review the privacy policies and terms of service of these providers.
The inclusion of any third-party data, restaurant listing, or product information in the app does not constitute an endorsement, recommendation, or warranty of that third party's products, services, or data accuracy.
16. User Data & Privacy
Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Local Data Storage
The following data is stored locally on your device and is not transmitted to our servers unless explicitly stated:
- Dietary preferences, allergen settings, and health condition selections
- Food journal entries (meals, nutrition data, streaks)
- Favorite food items and hidden food items
- Favorite restaurants
- Personal metrics (age, gender, height, weight, activity level, fitness goals)
- Nutrition targets (daily calorie, macro, and micronutrient goals)
- Cached menu data
This data is stored using your device's local storage (AsyncStorage). The app does not apply additional encryption beyond what your device's operating system provides, on modern iOS and Android devices, local app storage is encrypted at rest by the OS when your device is locked with a passcode, Face ID, or Touch ID. Anyone with physical access to your unlocked device may be able to access this data. You are responsible for securing your device with a passcode or biometric lock.
Data Transmitted to Servers
The following data is transmitted to our backend servers:
- Feedback, bug reports, and feature requests (with category and description text)
- Missing menu item reports (dining hall, date, meal time, item, anonymous device ID)
- Busy level reports (dining hall, level, anonymous device ID)
- Food and restaurant requests/suggestions
Submissions are associated with an anonymous device identifier, not with your name, email, or any personal account.
Analytics Data
Anonymous usage events (screens viewed, features used, food items viewed) are sent to PostHog for analytics purposes. Health condition changes and allergen conflict events may be included in analytics data. No personally identifiable information is sent. See our Privacy Policy for full details.
Data Deletion
You may delete all locally stored data by uninstalling the app or by using the reset function within the app (if available). For deletion of data stored on our servers (reports, feedback submissions), please contact us at contact@swipedining.com and we will process your request within 30 days.
17. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, Swipe Dining LLC expressly disclaims all warranties, including but not limited to:
- IMPLIED WARRANTIES of merchantability, fitness for a particular purpose, title, and non-infringement
- WARRANTIES OF ACCURACY regarding any nutrition data, health scores, allergen information, menu data, restaurant information, or product data displayed in the app
- WARRANTIES OF AVAILABILITY that the app will be uninterrupted, error-free, secure, or free from viruses or other harmful components
- WARRANTIES OF COMPLETENESS that all menu items, allergens, ingredients, or nutritional information will be displayed
- WARRANTIES OF SUITABILITY that the app's health scores, dietary information, or nutrition targets are appropriate for any individual's health needs
No information, whether oral or written, obtained by you from us or through the app creates any warranty not expressly stated in these terms.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWIPE DINING LLC, ITS DEVELOPERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, regardless of the cause of action or the theory of liability, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses
- PERSONAL INJURY OR HEALTH DAMAGES arising from or related to your use of or reliance on the app, including but not limited to allergic reactions, adverse health effects, dietary harm, or any medical condition exacerbated by reliance on the app's information
- DAMAGES ARISING FROM: (a) inaccurate, incomplete, or outdated nutrition data, health scores, allergen information, or menu data; (b) dietary decisions made based on the app's information or recommendations; (c) the failure of the app to display, warn about, or correctly identify any allergen, ingredient, or nutritional component; (d) crowdsourced data (missing reports, busy levels) that proves inaccurate; (e) service interruptions, data loss, technical errors, or app unavailability; (f) actions of third-party services integrated with the app; (g) unauthorized access to locally stored data on your device
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US FOR USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.
19. Assumption of Risk
By using Swipe, you expressly acknowledge and agree that:
- You use the app and all information it provides at your own risk
- You are solely responsible for all dietary decisions you make, regardless of information displayed in the app
- You understand that nutrition data, health scores, and allergen information in the app may be inaccurate, incomplete, or outdated
- You will independently verify all allergen and dietary information before consuming any food item, especially if you have food allergies, sensitivities, or medical dietary requirements
- You will consult with qualified healthcare professionals before relying on the app's information for any health-related decisions
- You will not use the app as a substitute for professional medical, nutritional, or dietary advice
- You assume all risk associated with any dietary decisions or food choices informed by the app's data
20. Indemnification
You agree not to hold Swipe Dining LLC, its developers, officers, employees, agents, or affiliates responsible for, and (to the extent permitted by law) to cover any reasonable claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) brought by a third party arising out of or related to:
- Your use of or reliance on the app or any information provided by the app
- Your violation of these terms
- Your violation of any rights of any third party
- Any content you submit through the app (including false or misleading reports)
- Any dietary decisions or food consumption choices you make based on information from the app
21. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these terms or the use of the app shall first be attempted to be resolved through good-faith informal negotiation. You agree to contact us at contact@swipedining.com and allow thirty (30) days to attempt informal resolution before initiating any formal proceedings.
If informal resolution is unsuccessful, any remaining dispute shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in New Haven County, Connecticut, or at another mutually agreed-upon location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
22. Class Action Waiver
YOU AND SWIPE DINING LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Swipe Dining LLC agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, consolidated, or representative proceeding.
If this class action waiver is found to be unenforceable, then the entirety of the arbitration provision in Section 21 shall be null and void, and any disputes shall be resolved in the state or federal courts located in New Haven County, Connecticut.
23. Termination
We reserve the right to restrict, suspend, or terminate your access to the app at any time, for any reason, with or without notice. Reasons for termination may include but are not limited to violations of these terms, abusive or fraudulent use of the app, or discontinuation of the service.
You may terminate your use of the app at any time by uninstalling it from your device. Upon termination, all locally stored data will be removed when the app is uninstalled.
The following sections shall survive termination of these terms: Sections 4 (Not a Medical Device), 5 (Health Disclaimer), 6 (Allergen Warning), 14 (Intellectual Property), 15 (Third-Party Services), 17 (Disclaimer of Warranties), 18 (Limitation of Liability), 19 (Assumption of Risk), 20 (Indemnification), 21 (Dispute Resolution), and 22 (Class Action Waiver).
24. Severability
If any provision of these terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
25. Force Majeure
We shall not be liable for any failure or delay in performance, or for any interruption, degradation, or unavailability of the app, resulting from causes beyond our reasonable control. Such causes include, without limitation: acts of God; natural disasters; fire; flood; epidemic or pandemic; war, terrorism, or civil unrest; labor disputes; government action or regulation; internet, telecommunications, or utility outages; failures of third-party services (including Supabase, PostHog, Sentry, Expo, Apple, Google, or cloud infrastructure providers); changes to or disruptions of the data sources we rely on (including redesigns, restrictions, or removal of publicly available university dining websites); and cyberattacks or other malicious conduct by third parties.
If a force majeure event materially affects our ability to provide the app, we will make commercially reasonable efforts to restore service and will notify users through the app or on swipedining.com when practicable.
26. Entire Agreement
These Terms of Service, together with our Privacy Policy and Health Disclaimer, constitute the entire agreement between you and Swipe Dining LLC regarding your use of the app. These terms supersede all prior or contemporaneous agreements, communications, or understandings, whether written or oral, relating to the app.
Our failure to enforce any provision of these terms shall not be deemed a waiver of that provision or our right to enforce it in the future.
27. Changes to These Terms
We reserve the right to modify these terms at any time. For material changes, including changes to dispute resolution, liability, data practices, or user obligations, we will provide at least thirty (30) days' advance notice before the changes take effect, via in-app notification, email (if you have provided one), or a prominent notice posted on swipedining.com. Non-material changes (typographical corrections, clarifications, updates to contact information) may take effect immediately upon posting, with the "Last updated" date revised at the top of this page.
Your continued use of the app after the effective date of revised terms constitutes your acceptance of the changes. If you do not agree to the revised terms, you must stop using the app before the effective date.
We encourage you to review these terms periodically for any updates.
